The plant produces hydrogen and is within the Miguel Hidalgo refinery in Tula.
The Mexican government published a decree on Thursday, April 18th, declaring the expropriation of the company Air Liquide, citing reasons of public utility.
It is a U-3400 hydrogen producer, belonging to the French company Air Liquide. The plant, located on a 6,451.78 square meter plot of land within the Miguel Hidalgo refinery, in Tula de Allende, state of Hidalgo, will become property of Pemex Industrial Transformation, as stipulated in the decree.
The plant had been sold by the government of Enrique Peña Nieto to the private company Air Liquide for US$52.7 million in 2017.
“This expropriation includes all assets and facilities related to the plant, as well as the services and inherent rights for its operation. Likewise, a previous decree that declared the supply of hydrogen from this plant of public utility, published in December 2023, is annulled,” stated the Ministry of Energy in the decree published in the Official Gazette of the Federation (DOF).
In this way, the government seeks to ensure the supply of hydrogen for strategic industrial activities and strengthen the operations of Pemex Industrial Transformation in the region.
The decree orders the immediate execution of the expropriation and the definitive occupation of the plant by Pemex Transformación Industrial.
Furthermore, it establishes that any means of defense will not suspend the immediate execution of the decree and that the company must cover the amount of compensation by the Expropriation Law.
Interested parties have a period of 10 business days to challenge the amount of compensation through the corresponding judicial procedure.
Pemex Industrial Transformation must register the decree in the Public Registry of Federal Property and the State Property Registry, and personally notify the interested parties, publishing the decree in the (DOF).
