AMLO creates a new National Customs Agency


The National Customs Agency of Mexico may contract the services of the Mexican armed forces to guarantee the fulfillment of its function.

MÉXICO, (July 15, 2021).- President Andrés Manuel López Obrador published a decree in the Official Gazette of the Federation (DOF) announcing the creation of the National Customs Agency of Mexico (ANAM), a decentralized body of the Ministry of Finance and Public Credit (SHCP).

This new unit, which is intended to operate separately from the Tax Administration Service (SAT), will have technical, operational, administrative, and managerial autonomy, at the same time that it will have fiscal and customs authority attributions.

For this action to take place, the Congress of the Union needs to implement a legal reform that certifies the transfer of functions of the General Administration of Customs that is in charge of the SAT.

“This decree will enter into force on the date on which the legal reforms that grant the competence that the Tax Administration Service currently has in fiscal and customs matters to the decentralized body provided for in this decree”, is detailed in one of the transitory articles of the DOF.

According to the federal president, the creation of this customs agency is necessary to strengthen this sector and provide prompt attention and support to importers and exporters.

Similarly, it indicates that cooperation and strengthening of national security are necessary as well as to standardize the procedures applied by the national customs service and inspection of international agreements signed by the country for the elimination of trade barriers.

The National Customs Agency of Mexico will have authority over assets, income, funds, and trusts. It is also noted that the decentralized body may contract the services of the armed forces to carry out its work.

Following the transitory provisions of the decree, the head of ANAM will be proposed by the head of the Treasury, however, Horacio Duarte, who currently directs the General Administration of Adunas, will be ratified in the position.

“For article 6 of this Decree, the Secretary of Finance and Public Credit will propose to the General Administrator of Customs of the Tax Administration Service, who is in office on the date of entry into force of the aforementioned Decree, as Head of the Agency National Customs of Mexico ”, AMLO stated.
