Nayarit Congress approves legal abortion

The Nayarit Congress approved the decriminalization of abortion up to 12 weeks of gestation, becoming the twentieth state in the country to legalize voluntary termination of pregnancy.

With 17 votes in favor and 12 against, legislators reformed the State Penal Code to guarantee the right of women to decide on their reproductive health, eliminating prison sentences for those who decide to terminate their pregnancy within that period.

In addition, the reform establishes more severe penalties for those who perform abortions without the consent of the woman and eliminates sanctions against medical personnel who perform procedures within the legal framework.

The presented opinion highlights that penalizing abortion violates women’s human rights, such as the right to health, equality, and autonomy, in line with what was dictated by the Supreme Court of Justice of the Nation, which has declared the absolute prohibition of abortion unconstitutional.

With this measure, Nayarit advances in the protection of women’s reproductive rights and aligns itself with the trend of several entities that have adopted progressive laws on sexual and reproductive health, marking an important milestone in the fight for gender equality in Mexico.
