Senator Salomón Jara, from Morena, presented an initiative to modify various secondary laws in order to punish up to three years in prison for anyone who “sabotages” a popular consultation or revocation of mandate.

“It should be clear that (..) any person can speak for or against the issue or matter that is presented in a popular consultation or revocation of mandate; But a different matter is to sabotage and openly and flagrantly attempt against a constitutional mandate, sabotaging and seeking to inhibit the exercise of the right of Mexicans to participate and vote in democratic processes in the sense that they deem most convenient ”, it is mentioned in the initiative.

The proposal that was presented last week by Senator Jara raises modifications to the General Law on Electoral Crimes to sanction from 50 to 100 days of fine and imprisonment from six months to three years to those who “in their own capacity or on behalf of third parties, contract propaganda on radio, television, social networks and/or any other means of communication aimed at delegitimizing the processes of popular consultation or revocation of mandate ”.

In the explanatory memorandum, the Oaxacan legislator recalls that in recent weeks the Yes for Mexico organization published a statement calling on citizens not to participate in the revocation of the mandate of President Andrés Manuel López Obrador.

“With this call, the opposition to the government of President Andrés Manuel López Obrador intends to once again sabotage a democratic exercise and inhibit the guarantee of the constitutional right of citizens to organize and be part of a direct and participatory popular democracy,” explains the Morenista.

The initiative also proposes to modify the Mandate Revocation Law and the Federal Law of Popular Consultation to establish that no person may contract propaganda on radio, television, and social networks or any other means of communication to influence the opinion of citizens about the revocation. mandate and popular consultation.

The legislator warned that the INE should investigate the sabotage campaign against the revocation of the mandate that is promoted by businessman Claudio X. González, who published a statement calling on citizens not to participate in the consultation of President Andrés Manuel López Obrador.

The initiative would reform the Federal Law of Popular Consultation, the Federal Law for the Revocation of Mandate and the General Law on Electoral Crimes to sanction people who contract propaganda on radio, television, social networks, or any other means of communication for the purpose to sabotage the process.
