By judicial order, the State Congress will have to approve what the Sinaloan deputies once rejected

Sin.- The Third District Court with headquarters in Sinaloa granted collective protection for members of the LGBT community in the state promoted by activist Tiago Ventura in which states that the Congress of the State must approve the egalitarian marriages.

On June 18, 2019, the State Congress with a morena majority voted against the initiative to reform articles 40 and 165 of the Family Code for the State of Sinaloa, which established the right of people of the same sex to marry.

Yesterday, the Judicial branch considered that said rejection went against the legitimate interest due to the effects that this minority suffered with the mandate of the Legislative branch.

Therefore, the third court granted indirect protection based on a legitimate interest in defense of a collective right, since the authority, with the ruling of the State Congress, violates human rights.

With this, the local congress must legislate in favor of the violated rights, in this case, marriage between people from the LGBT community.

According to the ruling, the Legislature must reverse and vote in favor of the reform to the Family Code three business days after it was issued. Since the ruling was issued since Friday afternoon, Congress must approve equal marriages during Tuesday’s regular session.

LGBT activists in Sinaloa are inviting the Congress session to witness the moment when the deputies vote in favor of the modifications to the family code.
