Gay couple from Baja California will be able to adopt

The Baja California gay couple made up of Víctor Aguirre and Fernando Urías will be able to adopt legally , this because a judge ordered the System for the Integral Development of the Family (DIF) to resolve the process that both began in 2017.

Víctor and Fernando became the first same-sex couple to marry in the state after a complicated process in 2015.

After submitting the application to adopt 4 years ago, a process that usually takes between 9 and 12 months, it was verified that the DIF had violated Article 17 of the Constitution by extending the process initiated by the couple without justification, even though the body itself had already approved the requirements.

The couple’s lawyer, José Luis Márquez , shared the resolution of the district judge, who ordered the DIF of Baja California to comply with the legal procedure since they had previously resorted to judicial protection.

The agency must abide by the order of the judge or otherwise there will be legal consequences for those responsible for obstructing the process.
